TERMS OF SERVICE

1. Agreement to Terms

By accessing or using Rooted History ("Service") at rootedhistory.io, operated by Rooted Security LLC ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Rooted History is a genealogy storytelling platform that:

  • Connects to your FamilySearch account via OAuth
  • Uses AI models (Anthropic's Claude to write, and xAI's Grok to check historical statements against outside sources) to generate historical biographies about deceased ancestors only
  • In paid biographies, shows a source or status for each sentence, and offers Historical Perspectives, simplified reading versions ("Relaxed Reading" and "For Kids"), and AI-voiced audio narration
  • Provides investigative tools for exploring your family tree

The Service is dependent on FamilySearch API availability and is subject to usage quotas.

3. Account & Eligibility

You must have a valid FamilySearch account and grant OAuth access. You represent that you meet FamilySearch's age requirements and have legal capacity to agree to these Terms.

We never receive or store your FamilySearch password.

4. Credits & Payment

  • Each Ancestor Chronicle uses one credit. Credits do not expire.
  • New accounts receive one free Ancestor Snapshot. A Snapshot is not a credit. We may grant additional Snapshots at our discretion.
  • We sell packs containing a fixed number of paid credits. Payments are processed by Stripe in U.S. Dollars. Prices do not include sales tax, VAT, or similar taxes; where we are required to collect them, they are added at checkout based on your billing address. Prices may change; credits you have already purchased keep everything an Ancestor Chronicle includes at the time you use them.

Ancestor Snapshots and Ancestor Chronicles

  • An Ancestor Snapshot includes the complete story, to read in the Service. It does not include per-sentence sources, Historical Perspectives, reading versions, narration, PDF download, or publishing to FamilySearch Memories.
  • An Ancestor Chronicle includes all of these.
  • You may turn an Ancestor Snapshot into an Ancestor Chronicle for a one-time fee shown in the Service. This adds per-sentence sources to that story and unlocks its Historical Perspectives, reading versions, narration, PDF download, and publishing to FamilySearch Memories. It applies to that one Snapshot only and does not use a credit.
  • Historical Perspectives, reading versions, and narration are generated the first time you request them.
  • We may grant additional credits or features to individual accounts at our discretion; such grants do not change these Terms.

Refund Policy (Digital Content)

  • You may request a refund of unused paid credits within 14 days of purchase from the Refunds section of your Profile Settings or by emailing support@rootedhistory.io.
  • Credits already used to generate a biography are non-refundable. By generating a biography you request immediate delivery of digital content and acknowledge that you lose the right of withdrawal for that credit (EU/UK and similar consumer laws).
  • A biography upgrade is non-refundable. By purchasing an upgrade you request immediate delivery of digital content and acknowledge that you lose the right of withdrawal for it. If we are ever required to refund an upgrade, that biography returns to the free version.

5. Acceptable Use & Prohibited Activities

You may use the Service for personal, family, and educational purposes.

You may not:

  • Use the Service for commercial purposes without attribution
  • Resell access or credits
  • Scrape, reverse-engineer, or automate the Service
  • Generate harassing, defamatory, or illegal content
  • Attempt to exceed quotas or breach security

6. Intellectual Property

The Service and its software are owned by Rooted Security LLC.

You retain ownership of your FamilySearch data.

You are granted a non-exclusive license to use generated stories for personal and family purposes. Public or commercial use requires attribution:

"Biography generated by Rooted History (rootedhistory.io) using AI and FamilySearch data."

6a. License to Generated Content

By using our service, you grant Rooted History a non-exclusive, royalty-free license to use, reproduce, and analyze content generated through the platform for purposes including quality assurance, service improvement, model training, and linguistic review. This license survives termination of your account. We will not publicly publish your generated content or share it in a manner that identifies you personally.

7. AI-Generated Content

Biographies, Historical Perspectives, and reading versions are written by AI models, and narration is produced with an AI-generated voice. Per-sentence sources and status labels show where a statement comes from, but AI output may still contain inaccuracies or "hallucinations," and outside sources can be wrong or disputed. We make no warranty of historical or factual accuracy. You are responsible for verifying important information.

8. Third-Party Dependencies

The Service relies on third parties including FamilySearch, Google Cloud (which hosts the Service and runs the AI models we use, including Anthropic's Claude and Google's Gemini), xAI (checking statements against outside sources), ElevenLabs (narration), and Stripe (payments). We are not responsible for their downtime, policy changes, or termination of your accounts with them.

The maps in the Service are provided by Google Maps. Your use of Google Maps features and content is subject to the then-current Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

9. Termination

We may suspend or terminate your access immediately for violation of these Terms. Upon termination you lose access to unused credits (except where required by law).

10. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOTED SECURITY LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR RESEARCH.

Our total liability is limited to the greater of (a) amounts you paid us in the prior 12 months or (b) US $100.

11. Indemnification

You will indemnify us against claims arising from your use of the Service or violation of these Terms.

12. Governing Law & Dispute Resolution

Texas law governs. U.S. users agree to binding individual arbitration through AAA (30-day opt-out available). No class actions.

If you believe content infringes your copyright, send notice to legal@rootedsecurity.io.
