TERMS OF SERVICE

1. Agreement to Terms

By accessing or using Rooted History ("Service") at rootedhistory.io, operated by Rooted Security LLC ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Rooted History is a genealogy storytelling platform that:

Connects to your FamilySearch account via OAuth
Uses Anthropic's Claude models to generate historical narratives about deceased ancestors only
Provides investigative tools and story packets with citations

The Service is dependent on FamilySearch API availability and is subject to usage quotas.

3. Account & Eligibility

You must have a valid FamilySearch account and grant OAuth access. You represent that you meet FamilySearch's age requirements and have legal capacity to agree to these Terms.

We never receive or store your FamilySearch password.

4. Story Packs & Payment

We sell non-expiring story packs containing a fixed number of story credits.
Each ancestor story consumes one credit.
Payments are processed via Stripe in U.S. Dollars.
Prices may change; purchased credits are grandfathered.

Refund Policy (Digital Content)

In most jurisdictions story-pack purchases are non-refundable once credits are used.

For unused credits, and to comply with EU/UK/Australian consumer law, you may request a full refund within 14 days of purchase by emailing support@rootedhistory.io. After stories are generated you explicitly waive the withdrawal right.

5. Acceptable Use & Prohibited Activities

You may use the Service for personal, family, and educational purposes.

You may not:

Use the Service for commercial purposes without attribution
Resell access or credits
Scrape, reverse-engineer, or automate the Service
Generate harassing, defamatory, or illegal content
Attempt to exceed quotas or breach security

6. Intellectual Property

The Service and its software are owned by Rooted Security LLC.

You retain ownership of your FamilySearch data.

You are granted a non-exclusive license to use generated stories for personal and family purposes. Public or commercial use requires attribution:

"Story generated by Rooted History (rootedhistory.io) using Anthropic Claude and FamilySearch data."

7. AI-Generated Content

Stories are creative interpretations produced by Anthropic's Claude models. They may contain inaccuracies or "hallucinations." We make no warranty of historical or factual accuracy. You are responsible for verifying important information.

8. Third-Party Dependencies

The Service relies on FamilySearch and Anthropic. We are not responsible for their downtime, policy changes, or termination of your accounts with them.

9. Termination

We may suspend or terminate your access immediately for violation of these Terms. Upon termination you lose access to unused credits (except where required by law).

10. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOTED SECURITY LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR RESEARCH.

Our total liability is limited to the greater of (a) amounts you paid us in the prior 12 months or (b) US $100.

11. Indemnification

You will indemnify us against claims arising from your use of the Service or violation of these Terms.

12. Governing Law & Dispute Resolution

Texas law governs. U.S. users agree to binding individual arbitration through AAA (30-day opt-out available). No class actions.

If you believe content infringes your copyright, send notice to legal@rootedsecurity.io.
